Privacy Policy & Data Protection (GDPR)
2.1 Data Controller
The data controller for all personal information processed through CreativeFormDoc is CreativeFormDoc, registered at 16 Rue des Tercières, 01470 Briord, France. All inquiries regarding data processing should be directed to [email protected].
2.2 Categories of Personal Data
We collect and process the following categories of personal data: full name, email address, telephone number, organization name, project specifications, and any additional information voluntarily provided through our requisition forms.
2.3 Legal Basis for Processing
Personal data is processed under Article 6(1)(b) of the GDPR (performance of a contract) and Article 6(1)(a) (consent). Data submitted through our contact forms is processed exclusively for project communication, delivery coordination, and statutory tax reporting obligations.
2.4 Data Retention
Personal data is retained for the duration necessary to fulfill the purposes for which it was collected. Project-related data is retained for a maximum of 5 years following the conclusion of the commercial engagement. Statutory financial records are retained for 10 years in accordance with French commercial law.
2.5 Data Security
All personal data is stored within encrypted EU-hosted cloud infrastructure compliant with ISO/IEC 27001 standards. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption, access controls, and regular security audits.
2.6 Your Rights
Under the GDPR, you have the right to: access your personal data, rectification of inaccurate data, erasure ("right to be forgotten"), restriction of processing, data portability, object to processing, and withdraw consent at any time. To exercise these rights, contact [email protected].
2.7 International Transfers
CreativeFormDoc does not transfer personal data outside the European Economic Area unless adequate safeguards are in place, including Standard Contractual Clauses approved by the European Commission.
California Consumer Privacy Act (CCPA) Compliance
For California residents, CreativeFormDoc complies with the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). You have the right to know what personal information we collect, use, and disclose about you.
You have the right to request deletion of your personal information, the right to opt-out of the sale of your personal information, and the right to non-discrimination for exercising your privacy rights.

Terms of Service
4.1 Scope of Services
CreativeFormDoc provides user interface design, component library development, motion design, and digital product engineering services as described in individual Statements of Work (SOW) executed between the Client and CreativeFormDoc.
4.2 Intellectual Property
Upon complete settlement of all agreed commercial invoices, CreativeFormDoc assigns all worldwide intellectual property rights in the client-specific deliverables, design tokens, component libraries, and digital assets directly to the Client. Pre-existing intellectual property and general-purpose tools remain the property of CreativeFormDoc.
4.3 Payment Terms
Invoices are payable within 14 days of issuance unless otherwise specified in the Statement of Work. Late payments incur a statutory interest rate of 3 times the French legal interest rate. CreativeFormDoc reserves the right to suspend work on outstanding balances.
4.4 Limitation of Liability
CreativeFormDoc's total aggregate liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. CreativeFormDoc shall not be liable for indirect, incidental, or consequential damages.
4.5 Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. Confidential information shall not be disclosed to third parties without prior written consent, except as required by law.
4.6 Governing Law
These Terms of Service are governed by the laws of the French Republic. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Lyon, France.
Refund & Reimbursement Policy
6.1 Eligibility
Refund requests are evaluated on a case-by-case basis. Projects that have not yet commenced are eligible for a full refund of any advance payments. Partial refunds may be issued for work completed up to the date of cancellation, proportional to the total project scope.
6.2 Non-Refundable Items
Deposits confirming project start, third-party licensing fees, stock assets, and hosting prepayments are non-refundable. Work already delivered and accepted by the Client is non-refundable.
6.3 Refund Process
To request a refund, contact [email protected] with your project reference and reason for the request. Refund decisions are communicated within 5 business days. Approved refunds are processed within 14 business days to the original payment method.
6.4 Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be submitted to mediation under the rules of the Mediation Centre of the Lyon Bar before any legal proceedings.
SLA & Uptime Commitments
Clients enrolled in active maintenance retainers benefit from our 99.98% uptime availability guarantee. Our dedicated monitoring systems check server health and security endpoints every 60 seconds.
In the event of a service disruption, our engineering team initiates resolution within a guaranteed 2-hour SLA window. Priority incident response includes automated escalation workflows and real-time status updates.
Monthly SLA reports are provided to retainer clients detailing uptime metrics, response times, and any incidents resolved during the reporting period.
